Custom Web Hosting reserves the right to refuse service and /or access to its servers to anyone.

Custom Web Hosting will not tolerate the use of its servers for storage of illegal or undesirable data including; 

• copyrighted works

• commercial audio, video, or music files

• any material in violation of any National, State or Local regulation

• adult material, pornography, erotic images, or otherwise lewd or obscene content

• warez, pirated software, ROMS, emulators, phreaking, hacking, password cracking or IP spoofing software

• Links or information on access to any above mentioned material.

Overuse Policy
  Custom Web Hosting reserves the right to detect when a website is monopolizing bandwidth and/or processor resources, and suspend that site at its discretion. This is intended to prevent the misuse of our servers. Clients will be notified to discuss such issues and possible alternative arrangements.

 

Payment Policy

All accounts are set up on a prepay basis.  All pricing is guaranteed for the period of prepayment.  Payment is due each anniversary year or month following the date the account was established.  Clients will automatically be charged again at the end of their prepay period unless closure notification has already been received by Custom Web Hosting.  Non-payment will result in suspension of all services until all due payments are processed.  No bills or invoices will be sent by regular mail unless arranged beforehand.  All invoices will be sent directly to clients via email.  All pricing is in Australian dollars unless otherwise noted.

 

Indemnification
Client agrees that it shall defend, indemnify, save and hold Custom Web Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney`s fees asserted against Custom Web Hosting, its agents, its clients, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by client, its agents, employees or assigns.  Client agrees to defend, indemnify and hold harmless Custom Web Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Custom Web Hosting`s server; (2) any material supplied by client infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to client from Custom Web Hosting`s server.

Custom Web Hosting will not be responsible for any damages your business may suffer. Custom Web Hosting makes no warranties of any kind, expressed or implied for services we provide. Custom Web Hosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Custom Web Hosting and its employees. Custom Web Hosting reserves the right to revise its policies at any time.
